GENERAL TERMS AND CONDITIONS OF SALE
1. Definitions
Within the framework of these General Terms and Conditions of Sale (hereinafter “the GTC”), the following terms, when capitalized and used in the singular and/or plural, have the following meanings:
“Users”: refers to any person visiting the DataScientest.com website
; “Client/Learner”: refers to any User who has subscribed to a Data Science training contract with DataScientest;
“Certificate of Completion”: a certificate issued to the Learner upon successful completion of the course and obtaining a passing grade; the Certificate of Completion summarizes all the skills acquired during the data science training program;
“Course”: a course in the form of text, images, or video, created by any expert in a given field; Courses may include exercises in the form of quizzes, assessments, and project presentations evaluated by Cohort Leaders.
“Cohort Leader”: An experienced Data Science expert responsible for mentoring the Learner individually or in a group; the Cohort Leader defines learning objectives and a progress plan for the Learner, provides pedagogical support for the successful completion of Projects, monitors the Learner’s data science training, and validates their skills during oral assessment sessions.
“Pathway”: Training for a profession or activity, comprised of Projects and Courses, with personalized pedagogical support from a Cohort Leader, offered to the Learner.
“Project”: Practical exercises offered to the Learner within a Pathway.
“Service”: Access to online educational services on the DataScientest Platform
2. General provisions relating to the General Terms and Conditions of Sale
These General Terms and Conditions of Sale define your rights and obligations as a Client/Learner within the framework of a contracted data science training program and apply for the entire duration that the Services are available online on the Platform. The General Terms and Conditions of Sale are binding on the Learner, who acknowledges, by checking the box provided for this purpose, having read and accepted them before beginning their training program. The General Terms and Conditions of Sale were provided prior to the order and are also accessible at any time on our Website and during the ordering process. They are issued by DataScientest, whose contact details are provided in Article 1, “Legal Notices,” of the General Terms and Conditions of Use, which must also be accepted.
3. Service Description
3.1. Prices and Route Selection
The price of each service is shown inclusive of all taxes and expressed in euros. You have the option to enroll in one of our data science certification programs, available in French and English.
3.2. Registration fees
A mandatory registration fee of five hundred (500) Euros will be required upon registration to reserve your place. No additional costs beyond the price of the original service purchased by the Client/Learner will be charged without the Client/Learner’s express consent. Finally, we reserve the right to refuse registration if you are a minor.

3.4. Modifying your route
If you wish to modify the course you have just subscribed to, you can contact our team by email at contact@datascientest.com. Any modification to your course will be subject to the approval of the DataScientest teaching team. Any course modification constitutes a new contract and is therefore subject to the same formalities as the initial contract.
3.5. Purpose of the order
The Data Science Training Program, which is the subject of this order, will be made available to the Client/Learner on the E-Learning platform.
All of the following educational information is accessible on the platform, in French and English: the program content, the provisional schedule for completing assignments (Assessments, Projects, group exercises), the schedule of sessions with the Cohort Leader, the average duration in hours, and the Data Science career paths accessible upon completion of the Program.
DataScientest grants the Client/Learner a non-exclusive and non-transferable license to use the Platform, which will be provided with a username and password on the first day of training.
This access allows the User to:
access the Platform and all Services for the entire duration of their training, starting from the date of receipt of the access confirmation email sent by DataScientest, after which access will be deactivated;
To benefit from personalized educational support with a data science expert, the Cohort Manager, who regularly monitors the Learner’s progress in data science skills.
To benefit from access to courses and practical exercises available online on the Platform.
To benefit from access to discussion forums with other Users, in accordance with the General Terms of Use and the Rules and Guidelines for Good Conduct.
Upon successful completion of a learning path, a Certificate of Completion attesting to the knowledge and skills acquired by the Client/Learner is issued.

3.6. Right of withdrawal
In accordance with Articles L.221-18 to L.221-28 of the French Consumer Code, the Client, provided they are legally considered a “consumer,” has 14 days to exercise their right of withdrawal. This right can be exercised by contacting the company in writing. The right of withdrawal does not apply in the cases referred to in Article L.221-28 of the French Commercial Code. Furthermore, the Client expressly waives their right of withdrawal by signing the Contract and/or an order form for a training course that begins before the end of the withdrawal period.
4. Learner Obligations
By subscribing to a Data Science training program at DataScientest, the Client/Learner agrees to comply with the commitments outlined in the Learner Regulations, including the rules regarding attendance at follow-up sessions. Please note that failure to comply with the Learner Regulations may result in sanctions imposed by the DataScientest Disciplinary Board. The Datascientest.com website is published by Datascientest, a company with a capital of €1,000, registered with the Paris Trade and Companies Register under number 831 450 069 (RCS Paris), whose registered office is located at 16 boulevard Flandrin, 75016 Paris, France, contact@Datascientest.com. 4.1. Cancellation
In accordance with the provisions of Article L221-28, paragraphs 1 and 13 of the French Consumer Code, no cancellation will be possible once the Client/Learner has used their access codes to access the training platform. This will constitute commencement of the training and a waiver of their right of withdrawal. Any cancellation or postponement of registration by the Client must be reported and confirmed in writing. Cancellations made more than fourteen (14) calendar days before the start of the course will not be charged. Cancellations made between fourteen (14) and seven (7) calendar days before the start of the course will be charged 20% of the course fee. Cancellations made less than seven (7) calendar days before the start of the course will be charged the full course fee. The contract may be terminated by the Client/Learner or their legal representative if, due to force majeure, they are prevented from attending the corresponding course.
4.2. Payment terms
DataScientest offers two (2) payment options for Training Fees. Registration Fees must be paid in full (article 3.2).
Once these fees are paid, the learner has the following options
: 1st option: full payment of training fees.
2nd option: payment in several monthly installments.
When confirming your order, our partner Pledg will offer you the option to pay in 3, 6, or 10 installments. If you wish to subscribe to this service, your contact information will be sent to Pledg, who, subject to approval of your application, will offer you the option to pay in 3, 6, or 10 installments and will provide you with a payment schedule summarizing the amount of each installment.
Depending on your application, supporting documents may be requested to validate your funding request. For payment in installments: as soon as Pledg accepts your application, you will need to pay the first installment, which includes a fee of 1.5% / 3.55% / 6.45% (depending on whether you have chosen to pay in 3, 6, or 10 installments respectively) of the total order amount. You will be charged for the remaining installments according to the payment schedule provided to you.
How the 3-installment payment works: The 3-installment payment option allows you to pay for your order placed on DataScientest as follows: A mandatory down payment, debited on the day of order confirmation, corresponds to a portion of the order and a fee of 1.5% of the total order amount, if the fee is not waived.
How it Works: Payment in 6 installments: The 6-installment payment option allows you to pay for your order placed on DataScientest as follows: A mandatory down payment, debited on the day of order confirmation, corresponding to a portion of the order and a fee of 3.55% of the total order amount, if the fee is not waived.
How it Works: Payment in 10 installments: The 10-installment payment option allows you to pay for your order placed on DataScientest as follows: A mandatory down payment, debited on the day of order confirmation, corresponding to a portion of the order and a fee of 6.45% of the total order amount, if the fee is not waived. The remaining amount of the order is then divided into the remaining monthly installments according to the payment schedule provided.
4.3. Payment
Payment can be made using the following methods: By credit card via the secure payment interface on the DataScientest platform. We use an online payment security system that encrypts the transmission of bank details. The payment module used is the “Stripe” system, a secure and certified platform. Please note that the learner will be automatically debited on the dates mentioned. The Client must then fill in their personal and banking details and accept the General Terms and Conditions of Sale by checking the box provided for this purpose. By check, made payable to DataScientest.
4.4. Default of payment
In the event of non-payment by the due date, we reserve the right to demand payment, suspend the performance of the relevant Services, or terminate the contract automatically. Any sum not paid by the due date will accrue interest at the legal rate, without prior notice.
Any sum owed by the Client/Learner that is not paid on time will automatically accrue interest at a rate of 5% per month from the due date, without prior notice. In any event, any Client/Learner in arrears will automatically owe DataScientest a minimum fixed penalty of forty euros for recovery costs (Article D.441-5 of the French Commercial Code). Furthermore, DataScientest reserves the right, fifteen days after sending a formal notice to pay by registered letter that is partially or totally ineffective, to suspend the Service until full payment of the sums due and if this payment is not made, to automatically terminate the contract with immediate effect.
4.5. Billing
An invoice is generated for each order placed. Your order invoices will only be sent electronically. Soon, electronic invoices will be available in .pdf format in your personal account on our platform.
5. Availability and modification of the Platform
The Services broadcast over the Internet are normally accessible 24 hours a day, 7 days a week, except in cases of force majeure, events beyond the control of DataScientest and/or the Service provider, potential outages, or maintenance interventions related to the technological evolution of the Platform or necessary to ensure the proper functioning of the Service. DataScientest reserves the right to perform interventions on the resources made available to Learners in order to carry out corrective, curative, or evolutionary maintenance of the site. Any remote maintenance will be preceded by notification to the Client via email 24 hours in advance. This maintenance will be carried out at night for one hour, once a week. We undertake to make every effort to guarantee the accessibility and continuity of the Platform’s Services, but we are only bound by an obligation of means regarding the continuity of access to the Service.
6. Responsibility
The Client/Learner is solely responsible for choosing, storing, and using the Services provided by DataScientest. The Client/Learner acknowledges and accepts the characteristics and limitations of internet data transmission, as well as the associated connection costs. They recognize that it is their responsibility to ensure that the technical specifications of their equipment allow them to access the service under optimal conditions, particularly with regard to internet document transmission, and to take all appropriate measures to protect themselves from contamination by potentially harmful programs. DataScientest’s liability can only be invoked in the event of proven fault or negligence and will be limited to direct damages suffered by the Client/Learner, excluding any indirect damages. Should DataScientest be found liable, the total amount of any sums payable by DataScientest shall not exceed the total price paid by the Client/Learner for the Service in question.
6.1. Intellectual Property
The content of the Courses and Learning Paths is the property of DataScientest and its partners. Trademarks, logos, symbols, and all site content (text, images, sound, etc.) are protected by the French Intellectual Property Code, and more specifically by copyright law. Users must obtain prior authorization from the site for any reproduction, publication, or copying of the various content. They agree to use the site’s content strictly for private purposes; any use for commercial or advertising purposes is strictly prohibited. Any total or partial reproduction of this site by any means whatsoever, without the express authorization of the website operator, constitutes an infringement punishable under Article L 335-2 et seq. of the French Intellectual Property Code. This is reiterated in accordance with Article L122-5 of the French Intellectual Property Code.

7. Mediation
In accordance with Article L. 612-1 of the French Consumer Code, subject to Article L. 612-2 of the same Code, consumers have the option of initiating an amicable dispute resolution process through mediation within one year of their written complaint to the professional. DataScientest has designated SAS Médiation Solution as its consumer mediation entity

The consumer must specify to the mediator what they expect from this mediation and why, – A copy of the initial complaint, – All documents relevant to the processing of the request (order form, invoice, proof of payment, etc.)
